  • Building works requiring approval must not commence before the necessary statutory permissions are obtained.
  • Planning permission may be required under the Town and Country Planning Act 1976 (Act 172) before the relevant building plan process can proceed.
  • The proposed development must comply with applicable land-use conditions, zoning, planning restrictions, and approved development requirements.

  • The Principal Submitting Person (PSP) or other authorised submitting professional must fulfil the statutory responsibilities applicable to the submission.
  • Structural design and calculations must be prepared or certified by appropriately qualified engineering professionals where required.
  • Proposed building extensions must be assessed against the existing approved plans and structural conditions.
  • The structural capacity of an existing factory must be assessed before additional loads, floors, or structural alterations are introduced.

  • Factory building plans must address applicable fire safety and means-of-escape requirements.
  • Technical referrals to BOMBA and other relevant agencies may be required.
  • Proposed industrial activities may require separate environmental assessments or approvals depending on the nature and scale of operations.
  • Earthworks, road and drainage works, sewerage, water supply, and electrical infrastructure may require separate technical plans or permissions.
  • Existing buildings must not be assumed compliant merely because they have been occupied for many years.
  • A previously issued CCC or CFO does not automatically approve subsequent unauthorised alterations.

  • An as-built drawing is not equivalent to an approved building plan.
  • Unauthorised extensions or renovations may require investigation, rectification, demolition, or other lawful compliance action.
  • Submission of a retrospective application does not guarantee that unauthorised works will be approved.
  • Factory construction must comply with the approved plans and conditions imposed by MBPG and relevant agencies.
  • The relevant construction stages and prescribed certifications must be managed by the responsible professionals.
  • Where applicable, CCC must be issued by a qualified PSP after statutory completion and compliance requirements are satisfied.
  • Building plan approval does not automatically authorise occupation or commencement of business operations.
  • A factory may require a separate MBPG business premises licence.
  • A manufacturing company may require a Manufacturing Licence or exemption confirmation under the relevant manufacturing licensing framework, depending on its eligibility.
  • Industrial machinery and equipment may be subject to separate DOSH/JKKP requirements.

  • False declarations, forged approvals, and misleading building plans must not be submitted.
  • Approval time depends on project complexity, completeness of documents, professional submissions, technical comments, and authority assessment.
  • No approval, completion certification, or acceptance of existing unauthorised structures is guaranteed.

  • Under Section 70(13) of Act 133, the general penalty for contravening relevant requirements of Section 70 may include a fine not exceeding RM50,000, imprisonment for a term not exceeding three years, or both, subject to the precise offence and current applicable statutory text.
  • Continuing offences may attract additional daily penalties where provided by the applicable law.
  • MBPG may take enforcement action against unauthorised construction or building alterations in accordance with its statutory powers.

  • A compound, where legally available, is not necessarily the same as the maximum court-imposed fine.
  • MBPG's actual compound amount, if any, depends on the offence, relevant provisions, and enforcement decision.
  • Payment of a compound or penalty does not automatically legalise unauthorised construction.
  • Retrospective plan submission does not guarantee approval or prevent lawful enforcement action.
