Important Rules & Compliance Standards

  • A company should assess whether its activity falls within the meaning of manufacturing under the Industrial Co-ordination Act 1975.
  • A manufacturing company with shareholders’ funds of RM2.5 million and above, or 75 or more full-time paid employees, is generally required to apply for a Manufacturing Licence.
  • A company that does not exceed both thresholds may apply for a Confirmation Letter for Exemption from Manufacturing Licence, subject to MIDA’s review and the applicable requirements.
  • Shareholders’ funds are not limited to paid-up capital and may include reserves and the profit-and-loss appropriation balance.
  • The company must provide accurate, complete, and genuine corporate, financial, factory, production, workforce, and technical information.
  • The proposed manufacturing activity, product, production process, machinery, premises, investment, raw materials, and workforce information should be consistent with the company’s actual operation.
  • Any change in company ownership, factory location, manufacturing activity, production capacity, machinery, workforce, or other material information may require review, notification, or a separate application, depending on the circumstances.
  • MIDA Manufacturing Licence or Exemption Letter is separate from SSM registration, local-authority premises licence, planning approval, building approval, BOMBA approval, JAS approval, JKKP requirements, product registration, halal certification, GMP, MESTI, Customs approval, and other sector licences.
  • The company must obtain all other approvals required for its premises, employees, products, machinery, safety, environment, storage, import/export, and operations before commencing the relevant activity.
  • Approval of a Manufacturing Licence does not automatically grant an investment incentive, tax incentive, duty exemption, import permit, foreign-worker approval, expatriate pass, or any other separate approval.
  • The company should retain original supporting documents and maintain records to support compliance checks or requests for clarification.
  • This service does not guarantee approval and does not include MIDA statutory fees, professional technical reports, architectural plans, environmental studies, factory renovation, machinery costs, local-authority fees, sector-licence fees, tax advice, Customs duties, or third-party charges unless specifically stated in the quotation.
