Important Rules & Compliance Standards

  • CFO and CCC are building occupation and completion compliance documents, not ordinary business licences.
  • The property must be located within MBAS's administrative jurisdiction for MBAS-related building record enquiries and regulatory coordination.
  • Buildings must comply with the Street, Drainage and Building Act 1974 (Act 133), applicable Uniform Building By-Laws in Kedah, approved building plans and relevant technical requirements.
  • A historical CFO lawfully issued under the former certification system is not automatically invalid merely because the CCC system was introduced.
  • CCC must be issued by an eligible Principal Submitting Person (PSP) in accordance with applicable statutory and professional requirements.
  • MBAS does not issue CCC on behalf of the PSP but retains its statutory building control and enforcement responsibilities.
  • The applicable CCC and building completion documents must be deposited or submitted through the procedure prescribed for the relevant project and authority.
  • The building must comply with approved building plans and applicable technical conditions before the appropriate completion certification can be issued.
  • Relevant Form G certifications and prescribed completion documents must be properly completed and certified by the responsible parties.
  • Structural safety, fire safety, access, sanitation, drainage, utilities and other applicable technical requirements must be satisfied.
  • Applicants requesting historical CFO/CCC records must provide accurate property identification, ownership or authorisation documents and supporting information as required.
  • Historical record searches depend on the availability of records, the authority's access procedures and the completeness of the information provided.
  • A missing copy of a CFO or CCC does not automatically establish that the building was constructed or occupied unlawfully.
  • An existing CFO or CCC does not automatically authorise subsequent building extensions, renovations, structural alterations or changes of use.
  • Additional planning permission, building plan approval or technical clearance may be required for modifications or changes in building use.
  • Building owners and responsible parties must comply with applicable legal requirements before occupying or permitting occupation of a building.
  • Where the original PSP is unavailable, any replacement professional arrangement must follow applicable statutory and professional procedures.
  • Technical inspections, structural reports, professional certifications and statutory declarations must be undertaken by appropriately qualified or authorised persons.
  • Applicants must provide genuine, accurate, complete and up-to-date documents for verification or submission.
  • Consultants cannot independently issue, certify, backdate or guarantee a CFO or CCC.
  • Submission of an enquiry or application does not guarantee retrieval of historical records, issuance of CCC or acceptance of documentation by another authority.

Compound & Legal Penalties

  • Rejection, delay or inability to proceed with related business licensing, property transactions or regulatory applications due to missing or incomplete CFO/CCC documentation.
  • Requirement to provide additional building plans, ownership records, technical reports, professional certifications or supporting documents.

  • Enforcement action for occupying or permitting occupation of a building contrary to applicable statutory requirements.
