• Application Process:
  • Applications must be submitted through the MBSA official licensing system or counter at Wisma MBSA before the event's commencement date.
  • Applicants need to provide:
    • A valid Suruhanjaya Syarikat Malaysia (SSM) business registration.
    • A valid active permanent MBSA business premise license (if the promotion is held directly outside or inside the applicant's existing retail lot).
    • An official written permission or approval letter from the building management or shopping mall landlord (if held inside a mall or private complex).
    • A detailed Location Site Plan (Pelan Lokasi) or booth layout plan indicating the exact site dimensions, walkway clearance, and booth arrangements.
    • Three photographs showing the exact spot where the promotional event or setup will take place.
  • Applications must be fully approved and payments cleared by the applicant prior to setting up any promotional structure or booth.
• Fees:
  • The fees are calculated dynamically based on the promotional location category (e.g., inside a mall vs. outside a shop walkway), total square footage used, and the total duration (number of days) of the event.
  • A security deposit (Wang Pertaruhan) may be required by MBSA for specific outdoor setups to ensure the site is returned to its original clean condition.
• Usage Period:
  • The license is strictly valid only for the specific approved dates and operating hours printed on the permit (typically ranging from a 3-day weekend up to a maximum of 30 consecutive days per application).
  • All promotional activities, setups, and structures must be completely dismantled and removed once the permitted expiration date is reached.
• Responsibilities of Lessees:
  • Ensure the promotional activity is conducted strictly within the approved boundaries and size limits as stated on the MBSA permit.
  • The official temporary MBSA promotional permit must be printed and prominently displayed at the promotional booth or counter at all times during the event.
  • Maintain the cleanliness, safety, and hygiene of the promotional zone, ensuring all trash is disposed of correctly at the end of each day.
  • Ensure that the placement of promotional counters, banners, or stock does not block public fire exits, main pathways, pedestrian traffic, or nearby drainage systems.

• Strict Boundary Control: All stocks, banners, speakers, and event staff must remain strictly inside the designated booth area. Encroaching onto unauthorized public walking lines or neighboring lots is strictly prohibited.
• No Permanent Structures: No permanent construction, drilling into public flooring, or heavy structural modifications are allowed for temporary promotional setups.
• Sound Control Regulations: The use of audio systems, microphones, or loud music for promotion must comply with MBSA noise control limits and must not cause any noise disturbance to neighboring retail spaces or public walkways.
• Prohibited Business Types: Temporary promotions involving restricted, hazardous, illegal, or unapproved product categories that violate MBSA general guidelines are strictly banned.
• Clean Site Reinstatement: The applicant is fully responsible for restoring the site to its exact original condition immediately after the event ends, including removing all promotional tape, wires, and temporary waste.

• Operating Without a Temporary Permit: Conducting a promotional event, roadshow, or sidewalk sale without a valid MBSA temporary promotional license is a direct offense under the MBSA Licensing Trade, Business and Industries Bylaws. Enforcement officers have the right to issue immediate heavy cash compounds and shut down the event.
• Encroachment & Obstruction: Exceeding the approved plot dimensions or blocking public walkways and fire routes with promotional items will trigger statutory fines and immediate item confiscations (Sita) by MBSA enforcement teams.
• Noise and Nuisance Violations: Violating MBSA audio guidelines or causing public disturbance after warnings will result in compounding fines and the immediate cancellation of the temporary event permit.
• Failure to Clean Site: Leaving the promotional site dirty, damaged, or filled with commercial waste will result in the direct forfeiture of the security deposit, and MBSA may blacklist the company from future temporary license approvals.
• Immediate Revocation: MBSA reserves the absolute right to terminate and cancel the promotional permit immediately without refund if the event breaks local safety guidelines, creates unexpected traffic congestion, or violates public order.
